THE “TREY’S ANGELS” CONTEST 2011 OFFICIAL RULES THIS CONTEST IS INTENDED ONLY FOR UNITED STATES (EXCLUDING PUERTO RICO) RESIDENTS WHO ARE LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. 1. ELIGIBILITY: Open to legal residents of the United States of America (excluding Puerto Rico) who as of the start date of the Sweepstakes were (i) 18 years of age or older, (ii) had Internet access, and (iii) were members of the Trey Songz Official Fan Club (the “Fan Club”). Employees, officers, directors and agents of Atlantic Recording Corporation (“Sponsor”) and its parents, affiliated and subsidiary companies, advertising and promotional agencies, web masters and web suppliers and the immediate family (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of each (whether or not related) are not eligible. 2. TO ENTER: Beginning 10:00:01 am EST on September 14, 2011 (the “Start Date”), log on to Trey Songz’s official website available at: http://www.treysongz.com/ (the “Website”), and follow the instructions as set out in the blog post regarding the Contest, including taking a photo of yourself wearing your Trey’s Angels t-shirt together with your Passion, Pain & Pleasure album and upload that picture to Twitter as your Twitcon, and submitting your response as directed in the blog post, including sending a tweet saying “Happy Anniversary!” to @treysangels (the "Entry"),. Limit 1 entry per person. Entries must be submitted by 5:00:00 pm EST and received no later than 5:00:59 pm EST on September 14, 2011 (the “End Date”). Sponsor is not responsible for lost, late, stolen, mutilated, damaged, incomplete, illegible or misdirected entries or for malfunctions of electronic equipment, computer hardware or software, or any other technical problems related to website entries. Entries become property of Sponsor and will not be returned. Any attempt at Entry except as above stated is void. Sponsor’s computer will be the official clock of the Contest. Sponsor will disqualify any Entries that do not meet the aforementioned requirements. 3. JUDGING: The first entrant to follow the directions in the blog post, and sending a tweet saying “Happy Anniversary!” to @treysangels will be determined at or about 3:00:00 pm EST on September 15, 2011 from all eligible Entries received and announced on the Website. The decision of the Sponsor, the judge of the Contest, is final and binding on all matters relating to the Contest. The potential winner will be notified by email and may be required to sign, notarize and return an affidavit of eligibility/liability and publicity release within 7 days of the date of notification or the prize will be forfeited and an alternate winner will be selected. If a potential winner is a minor in his/her state of residence, such potential winner's parent or legal guardian must sign all required documents. If a potential winner is not available within 24 hours of first attempt by Sponsor to contact such potential winner or prize notification is returned as undeliverable, prize will be forfeited and an alternate winner will be selected from eligible entries received. 4. PRIZE: One (1) winner will receive a custom hoodie, in a size medium, from the Trey’s Angels web store. Approximate Retail Value (“ARV”) is $54. All taxes (including without limitation federal, state, and local taxes) on or connected with the Prize, if any, and the reporting consequences thereof, and any other costs, fees, and expenses not explicitly stated herein, if any, are the sole responsibility of winner. Prize is not transferable. No cash redemptions or prize substitutions allowed, except at the Sponsor's sole discretion. Prize will be awarded. In the unlikely event that any portion of the prize is cancelled or undeliverable for any reason, winner agrees Sponsor has no further obligations to winner other than delivery of the remainder of the Prize. 5. GENERAL CONDITIONS: All federal, state, and local taxes related to the prize are the winner's responsibility. The contest is governed by the laws of the State of New York with venues in New York County, New York, and all claims must be resolved in the state or federal courts of New York County, New York. All federal, state and local laws and regulations apply. In the event of a dispute regarding the identity of the person submitting an online Entry, the Entry will be deemed to be submitted by the person in whose name the email account is registered. Sponsor reserves the right to modify, suspend or terminate the online portion of the Contest in the event that it becomes infected by a computer virus or is otherwise technically impaired. Upon submitting an Entry, participants agree: (a) to be bound by the Official Rules, Sponsor's privacy policy and the decisions of the judge of the Contest, whose decisions regarding the Contest are final and binding; (b) to release and hold harmless Sponsor and its agents from any and all claims, demands, damages, losses or liabilities, including injury or death, caused by, arising out of, or related to their participation in the Contest and/or their use/misuse of the prize; and (c) to be contacted by Sponsor via email, telephone and/or mail. 6.
